- TeleBrief: Martin Previews March MeetingYesterday, FCC Chairman Kevin Martin met with reporters to discuss the agenda for the Commission's March 19 Open Meeting. One item on the agenda will be the issue of exclusivity contracts between telecom providers and the owners of multiple dwelling unit buildings; that issue is a follow-up to the 2007 order that prohibited exclusive contracts between cable providers and MDUs. "This would make clear that any telecommunications carrier, including CLECs who don't have the same unbundling obligations as incumbent carriers do, are also prohibited from having an exclusive arrangement for apartment buildings," Martin said. Other items on the agenda will include broadband deployment and spectrum issues.

McCormick Jr. will testify before the House Subcommittee on Telecommunications and the Internet at a hearing on the net regulation bill introduced earlier this year by Subcommittee Chairman Ed Markey (D – Mass.). McCormick is expected to raise concerns to the subcommittee about several provisions of the bill that could increase uncertainty in the industry and chill investment, leading to less broadband deployment and a subsequent reduction in the many benefits broadband brings consumers.
- TeleBrief: Senate Looks at DTV and Vulnerable PopulationsOn Tuesday, the Senate Commerce Committee held a hearing to discuss outreach and education efforts in advance of the February 2009 digital television transition. In particular, the Committee was interested in efforts to inform rural and elderly populations—both of which are more likely to receive over-the-air broadcast television—about the DTV transition. Despite outreach efforts by the FCC, NTIA, and various associations, senators remain concerned about the potential effects of the transition on their constituents. FCC Chairman Kevin Martin assured the Committee that the FCC “intend[s] to take whatever actions are necessary to minimize the potential burden the digital transition could impose on consumers and maximize their ability to benefit from it.” Although those actions include things like establishing partnerships with groups that work with vulnerable populations, as we have reported previously, carriers with DTV transition education obligations should expect vigorous enforcement of the Commission’s outreach rules.
- Crossroads Express: Commission Moves on DTV Enforcement Action – FCC Chairman Testifies Before SenateThe digital television (DTV) transition took center stage in Washington, DC, last week with the FCC issuing 11 enforcement orders relating to the transition and FCC Chairman Kevin J. Martin testifying before the Senate (see April 9 Telebrief). According to a press release issued concurrently with adoption of the enforcement orders, the actions “demonstrate the Commission’s commitment to strong enforcement in promoting the successful transition” to DTV. At the same time, Chairman Martin testified before the Senate Committee on Commerce, Science and Transportation regarding the FCC’s efforts relating to the DTV transition. In his testimony, Chairman Martin highlighted the obligations of video providers and LifeLine and Link-Up providers to notify their customers of the pending transition.

- TeleBrief: House Overrides President’s Farm Bill VetoCiting continued subsidies for the wealthy as well as a $20 billion funding increase, as expected, today President Bush vetoed the Farm bill. House Democratic leaders immediately held their planned veto override vote, and overturned the President's decision by a vote of X to Y. Senate Majority Leader Reid said the Senate would vote to overturn the president's decision "as quickly as possible." The legislation contains important changes to the RUS broadband loan program sought by USTelecom and both branches originally cleared the conference report with more than the two-thirds majority required to overturn the President’s decision.
