			<content:encoded><![CDATA[<p>USTelecom has been working with various government and private sector entities on efforts related to pandemic influenza preparedness, which we discussed in-depth in a <a href="http://www.ustelecom.org/MembersArea/NewsLetters/CrossRoads/Crossroads-Express-In-Depth-Preparing-for-the-Worst-Pandemic-Flu-and-Your-Business.html">recent edition of Crossroads Express</a>.  Because of those ongoing efforts, USTelecom members are invited to participate in a live cross-sector webinar on July 11, 2008, where infrastructure owners and operators will be briefed on recent information and developments in preparedness planning.  <a href="https://www2.gotomeeting.com/register/252350351">You can register for the webinar here</a>. 			<content:encoded><![CDATA[<p>As <a href="http://www.ustelecom.org/Video_Blogs/Blog/index.php/2008/07/01/court-delivers-win-for-video-competition/">Tom noted yesterday</a>, the Court of  Appeals for the 6th Circuit released a decision on Friday upholding the FCC&#8217;s  authority to open up markets in video services by instructing cable franchising  authorities to reduce barriers to entry for telecom companies.  We sat down  yesterday with USTelecom&#8217;s Senior VP for Law and Policy Jon Banks to discuss the court  decision and the original FCC order that the decision  upheld.</p>

			<content:encoded><![CDATA[<p>We were asked to share  our thoughts <a href="http://blog.thehill.com/2008/07/01/court-delivers-win-for-video-competition/">in a post</a> at The Hill&#8217;s <a href="http://blog.thehill.com/">Congress  Blog</a> about last Friday&#8217;s <a href="http://www.ca6.uscourts.gov/opinions.pdf/08a0230p-06.pdf">decision by the Court of Appeals for the  6th Circuit</a>, which upheld the FCC&#8217;s 2007 Order streamlining the local  franchising process for telecom companies trying to compete with cable  companies.</p>
<blockquote><p>The FCC Chairman has long recognized  that competition with cable offerings provides the best solution to rising cable  prices, and that lowering hurdles for telecom companies to invest in video helps  increase the availability and capacity of broadband networks. The court&#8217;s  decision provides invaluable support for this vital objective and USTelecom and  our member companies will continue the work to achieve the goals of increased  investment in broadband networks and a level regulatory playing  field.</p></blockquote>

			<content:encoded><![CDATA[<p>On Tuesday, I attended the House  Telecom Subcommittee hearing on universal service, where a notable  witness-filmmaker George Lucas-<a href="blocked::http://www.reuters.com/article/politicsNews/idUSN2436420820080624?pageNumber=1&amp;virtualBrandChannel=0" title="blocked::http://www.reuters.com/article/politicsNews/idUSN2436420820080624?pageNumber=1&amp;virtualBrandChannel=0 http://www.reuters.com/article/politicsNews/idUSN2436420820080624?pageNumber=1&amp;virtualBrandChannel=0">came to testify</a> on the  benefits of broadband for education.  Lucas, whose <a href="blocked::http://www.edutopia.org/" title="blocked::http://www.edutopia.org/ http://www.edutopia.org/">George Lucas  Educational Foundation</a> works to integrate  technology in education, told the subcommittee that &#8220;access to modern  telecommunications tools for education should be viewed as a digital civil  right.&#8221;</p>
<p>Chairman Ed Markey  (D - Mass.) noted that there are a lot of questions related to universal service  that need to be tackled in reforming the program, including the big question of  whether or not the universal service system should be used to support broadband  service.  The representatives in attendance at the hearing-and the  witnesses-were divided on the issue of using USF dollars for  broadband.</p>
<p>Two Congressmen who are  <em>not</em> divided on the broadband  issue, Reps. Joe Barton (R - Texas) and Cliff Stearns, (R - Fla.),  <a href="blocked::http://republicans.energycommerce.house.gov/News/PRArticle.aspx?NewsID=6746" title="blocked::http://republicans.energycommerce.house.gov/News/PRArticle.aspx?NewsID=6746 http://republicans.energycommerce.house.gov/News/PRArticle.aspx?NewsID=6746">introduced legislation  yesterday</a> to reform universal service.  Their  bill would limit USF support to voice services only (closing the door on the  broadband debate) and it includes some substantial belt-tightening measures,  including a hard cap on funding, stricter eligibility requirements for areas  qualifying for assistance, and reverse auctions.</p>

			<content:encoded><![CDATA[<p>Although the decision was adopted  Friday, yesterday the FCC formally released its <a href="http://hraunfoss.fcc.gov/edocs_public/attachmatch/FCC-08-159A1.pdf" title="http://hraunfoss.fcc.gov/edocs_public/attachmatch/FCC-08-159A1.pdf">Memorandum  Opinion and Order</a> in the complaint against Verizon by cable companies  operating as competitive voice service providers.  The finding was that Verizon&#8217;s retention program&#8211;using  targeted marketing calls to customers who have requested a local number port to  a different carrier&#8211;violates section 222(b) of the Communications Act &#8220;by  using, for customer retention marketing purposes, proprietary information of  other carriers that it receives in the local number porting  process.&#8221;</p>
<p>Chairman Martin took  the sensible position of <a href="http://hraunfoss.fcc.gov/edocs_public/attachmatch/FCC-08-159A2.pdf" title="http://hraunfoss.fcc.gov/edocs_public/attachmatch/FCC-08-159A2.pdf" tyle="color: #4D6FA1; text-decoration: none;">strongly disagreeing with the  Order</a>, noting that cable providers engage in the very same kind of  &#8220;win-back&#8221; marketing when their own customers want to switch video service  providers; the particular rules in question only apply during local number  porting for traditional voice service providers, not to cable. Martin added that  companies offering identical bundled services should be regulated the same,  regardless of platform.  He summed up his dissent by stating that the decision  could &#8220;thwart competition, harm rural America,  and frustrate regulatory parity.&#8221;</p>
