Statement: USTelecom, CTIA, NCTA and ACA Oppose Vermont Effort to Evade Legal Challenge to Unlawful State Open Internet Regulations

Background: USTelecom, CTIA, NCTA and ACA – representing America’s broadband providers – have today filed separate motions opposing the State of Vermont’s attempt to dismiss and stay a federal lawsuit challenging the constitutionality of Vermont’s Internet Bill (S. 289) and Executive Order No. 2-18, calling instead for the court to issue a declaratory judgment that both state actions are unconstitutional and preempted. 

The following statement can be attributed to USTelecom, CTIA, NCTA and ACA:

“Broadband providers stand with customers in support of an open internet, but we can’t reach this goal with a 50-state patchwork approach. Vermont’s actions will threaten service for customers, hamper innovation and dampen investment in local communities. Two things should happen next. First, the court should declare Vermont’s actions preempted and stop enforcement. Second, Congress should finally take up the mantle on behalf of consumers and move forward with a national framework that safeguards the open internet for all Americans.”
